So what’s the deal with this shit? Can I just go to CVS tomorrow and buy some dope? Do I need a doctor’s note? And if so how do you get a note? What do I have to say? That I need it to fix my hunchback neck? Will that work? Are there any code words? I’m so intrigued by this? Can I start throwing Weed Foam parties? Are we a hippy state now? @johnnymanchuk – Not true, my friend. The federal government only has jurisdiction over interstate commerce. Those states are well within their legal rights to make marijuana legal and the feds can’t do anything about it. They may try, but what we’ve just seen is the beginning of the end of prohibition on weed. For me personally, this is much more important than who won the election.

@SlapHappy, i’m quite aware of how the commerce clause works, it’s just that in this day and age it’s extremely difficult to keep something like this completely intrastate. i suspect that if the Federal government decides to enforce their ban, they’ll find a way to do it. that being said, if PA passed a law like this, i would be first in line

The reason the Feds don’t go into states and arrest people/ shut down dispensaries is because Bush issued an executive order in his second term, which Obama continued, telling the DEA to not Enforce due to 1) huge public backlash in those states and 2) limited DEA resources

SlapHappy: actually, the interstate commerce clause is the exact reason that there is a pre-emptive federal law making weed illegal. As johnnymanchuk says, intrastate weed inevitably crosses state lines. You might want to read the Supreme Court case Gonzalez v. Raich where this was all spelled out very clearly. The CO/WA votes do absolutely nothing to change this. Also, presmoobs is right about the lack of enforcement under Bush/Obama but that’s already shifted a LOT. The feds have taken unprecedented interest in CA’s medical marijuana dispensaries recently, and you can count on them doing the same in CO/WA/MA and any other state that decriminalizes marijuana, medicinally or recreationally.
I think the whole medical marijuana movement is complete bullshit and was basically just a weak end around to prohibition. I like that CO and WA voters have said fuck it, let’s just make it legal. I’m not sure what the feds will do, but I am aware that both the DEA and the IRS have been aggressively targeting the weed industry in CA in recent years. That’s been one of the many gripes I’ve had with Obama; for someone who used to hang out with a group of people who called themselves the “Choom Gang” he’s been a complete dick when it comes to weed.

too funny that some people really believe its only restricted to people with cancer, aids or Hep C. they used those examples on the ballot of people that would be qualified for “serious ailments”. what you failed to read is that it’s for serious ailments like those OR at your doctor’s discression. so if you can convince your doctor you have a serious need for it you can still get it if you don’t have cancer. the law is a carbon copy of the CA law w/ the huge loophole wording that would allow a primary care physician to prescribe it for whatever reason he deems valid. You will be able to get it fairly easily I’m sure once the systems starts getting things in place. Regardless, it is already decriminalized for up to an ounce on your person, which is more than I’d buy at a time anyhow – the fine is less than most speeding tickets. People still speed and people will still smoke pot. I wouldn’t mind getting it medicinally but it seems like that would open up more legal problems like if I were to get caught giving my stash to someone w/o a card or smoking w/ someone w/o a card I would get into more trouble legally if I had no card and just had under an ounce.
In regards to the federal govt. attacking states who have legalized marijuana- does anyone else find it ironic that the federal govt. has resources to waste persecuting states who have legalized marijuana and are building revenue and tax dollars out of it, along w/ a literal industry to boot that will generate jobs, YET – when states like Arizona and New Mexico try and impose FEDERAL immigration law because the fed. govt. is too incompetent to successfully enforce their own laws everyone is up in arms. If the MA law is really just a copy of the CA law then here’s how it’ll work. Over time, some “doctors” will set up shop and charge 40-50 dollars a pop for the medical card. At the same time, dispensaries will pop up to cater those “patients”. Being out here in LA, I find that the variety and quality of marijuana is much better than what I was getting before it was “legal”
The fact that the feds crack down on medical marijuana at all is ridiculous. There will be a huge backlash in Colorado if they try to stop us. The evidence supporting legalization is irrefutable. They should stop wasting their money trying to stop people from taking a drug thats less dangerous than alcohol, tobacco and numerous prescription drugs. Colorado’s amendment is going to give this state millions in tax revenue with the first $40 million dollars going to education, not to mention the money saved in law enforcement. If you really want to move foreword, Obama, don’t let politics get in the way of logic and reason. You’re in there for 4 more years and thats it. Do a better job.
