LOUISVILLE – A gossip website has been hit with an $11 million judgment for libel and slander after posting false accusations about a Northern Kentucky teacher who sidelines as a Cincinnati Bengals cheerleader. The judgment against Dirty World Entertainment Recordings, which runs the site Thedirt.com, came Thursday after the site declined to answer a lawsuit brought by Sarah Jones, a high school teacher whose picture was posted on the site along with an accusation she had been exposed to two venereal diseases. U.S. District Judge William O. Bertelsman added an annual interest rate of 0.25 percent to the $1 million in compensatory damages and $10 million in punitive damages. An e-mail message sent to the operator of the Arizona-based website, Hooman Karamian, who uses the online name “Nik Ritchie,” was not immediately returned Thursday morning.

He’s almost certainly toast. State-court judges can be loosey-goosey on procedural rules, but you don’t fuck around in federal court. If her lawyers were smart, they tried to serve Hooman with the complaint multiple times and put him on notice of the suit in multiple ways, e.g. regular mail, certified mail, etc., so there can be no mistaking that he had formal notice of the filing of the suit. He probably was on a coke binge when the sheriff arrived with the summons and forgot to call his lawyer.
Also, 42 USC Section 1324 makes that haircut illegal, so he’ll have to do jail time, too.

The likely scenario is that Hooman will appeal, and a settlement will be reached in which this judgment is vacated by the plaintiff in favor of a lesser amount of money. Regardless, seems like he’ll have to break out his check book no matter what.
Moreover, think of the precedent this will set. I can envision another 50 lawsuits aimed at him and that, I think, will spell the end.

I find it odd that his lawyer’s did not fight it – Default judgment! The only thing I can think of is to fight this procedurally on a technicality that he was not served so he had no way to defend himself. If that’s his defense its odd because the publicity is going to do him more harm then good and inspire others.
A judgement like this is important for what it says. It tells every two-bit victim of smut peddling to come running out looking for money…..be careful.
IP and Deke are right, its a default judgment, so this will not stand as long as he appeals. He’s definitely going to end up paying her now that he let it get to this point, but it won’t be for nearly that much.
